Terms of Service

Welcome to SharaSpot, a parking discovery and booking service operated under the brand Folonite (“we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access and use of our services, including but not limited to the WhatsApp-based SharaSpot bot, our website, any associated tools, features, content, and any applications offered by SharaSpot (collectively, the “Service”).

By using our Service, you agree to these Terms. If you do not agree, please do not use SharaSpot.

1. Service Overview

SharaSpot helps you to search, reserve, and manage parking spaces, as well as to interact with an AI-based travel planning and parking assistant. SharaSpot works in collaboration with parking owners, including private individuals, hotels, commercial buildings, malls, or other entities, to list parking slots for booking by you (the “User”).

2. Eligibility

  • You must be at least 18 years old to use this Service.
  • If you are under 18, you may use the Service only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
  • You confirm that you are legally competent to enter into binding agreements.
  • You agree to provide accurate information during registration or booking.

3. Booking

  • Users may book parking slots using the WhatsApp interface or other interfaces we provide.
  • Bookings are subject to availability.
  • SharaSpot does not guarantee any parking space beyond what is confirmed in your booking.
  • In case a selected parking space becomes unavailable, we will attempt to reassign you to the nearest available space, if possible.

5. User Responsibilities

  • You are responsible for arriving on time and using the correct parking slot as directed.
  • You must remove your vehicle before your booked time expires, unless you extend the booking with consent from the owner.
  • You agree not to damage, vandalize, misuse, or leave trash at the parking space.
  • You must comply with local traffic rules, safety laws, and any guidelines posted at the parking location.
  • You will manually “unslot” your booking after you depart, as required by SharaSpot’s process.
  • You acknowledge that parking is at your own risk; SharaSpot does not insure your vehicle against theft or damage.

6. Owner Responsibilities

  • Owners must provide truthful, accurate information about the parking location, including the size, restrictions, time availability, and pricing.
  • Owners must keep their slot status updated using the owner dashboard or WhatsApp commands.
  • Booking Priority: Owners agree to prioritize reservations made through SharaSpot over any walk-in customers. In case of conflict, the confirmed SharaSpot booking must take precedence.
  • Maintenance and Safety: Owners must keep their parking space safe, accessible, and usable, ensuring it is free of hazards and in compliance with local safety regulations.
  • Complaint Handling: Owners are expected to cooperate promptly with SharaSpot support staff to address and resolve any user complaints, disputes, or service issues.
  • Legal Compliance: Owners are solely responsible for obtaining and maintaining any permits, municipal permissions, licenses, or tax registrations required to legally offer their parking space, and for complying with all applicable laws and regulations in their jurisdiction.

7. Prohibited Uses

  • Violate any applicable local, state, national, or international law or regulation while using the Service.
  • Impersonate any person or entity, or submit information that is false, misleading, or fraudulent.
  • Use automated scripts, bots, scrapers, or similar technologies to access, modify, or interact with the Service without prior written permission.
  • Resell, sublicense, share, or misuse any booking data or user information obtained through the Service for unauthorized or commercial purposes.
  • Tamper with, disable, or interfere with any security-related features or protective systems of the Service.
  • Engage in harassment, intimidation, threats, or fraud directed at any other user, parking owner, or SharaSpot staff.
  • Attempt to reverse-engineer, decompile, disassemble, exploit, or hack any aspect of the Service or related systems.

8. Platform Rights

  • SharaSpot reserves the right, at its sole discretion, to:
  • Refuse, block, or cancel any booking if there is reasonable suspicion of fraud, abuse, policy violation, or other harmful behavior.
  • Suspend, restrict, or permanently terminate your account if you repeatedly violate these Terms or other SharaSpot policies.
  • Change, modify, add, or remove features, services, or functionalities at any time without prior notice and without incurring liability for doing so.
  • Collect, store, and process limited personal data, including booking details, user communications, and payment information, as described in our Privacy Policy.
  • Monitor communications conducted through our platform or integrated channels (such as WhatsApp Business API) for the purposes of service quality, user safety, and compliance.

9. Third-Party Relationships

  • SharaSpot serves strictly as a technology platform and facilitator between Users and Owners, enabling parking transactions. Unless specifically stated, SharaSpot does not own, operate, or manage the listed parking spaces.
  • Contracts and arrangements for parking services are solely between the User and the Owner.
  • Accordingly, SharaSpot disclaims liability for:
  • Any damage to, loss of, or theft of your vehicle or its contents while parked on the Owner’s premises.
  • Any personal injury, bodily harm, or accident that may occur on or near the Owner’s property.
  • Any actions or misbehavior of third parties, including but not limited to vandalism, disturbances, or illegal activity, at the parking location.

However, SharaSpot is committed to supporting Users and Owners in resolving disputes in good faith and to the best of our ability through our customer support channels.

10. Limitation of Liability

  • To the maximum extent permitted by law, SharaSpot, its founders, employees, partners, and affiliates shall not be liable for:
  • Any indirect, incidental, consequential, or special damages
  • Any lost profits, lost data, or lost opportunities
  • Any damage caused by third-party actions, acts of God, strikes, riots, or force majeure
  • Our maximum liability is limited to the amount you paid for the specific booking that gave rise to the dispute.

11. Indemnification

  • You agree to indemnify, defend, and hold harmless SharaSpot, its owners, employees, partners, and affiliates from any and all claims, damages, liabilities, costs, and expenses arising from:
  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including property damage or personal injury on any parking premises

12. Intellectual Property

  • SharaSpot retains all intellectual property rights in the Service, including:
  • Logos, branding, and trade names
  • Chatbot conversation designs
  • Software code and related materials
  • You are granted a limited, non-exclusive, non-transferable license to use SharaSpot only as permitted by these Terms.

13. Dispute Resolution

  • In case of a dispute:
  • Users must first contact SharaSpot support to attempt informal resolution.
  • If unresolved, the parties agree to mediation or arbitration under the Indian Arbitration and Conciliation Act, 1996.
  • Jurisdiction shall lie with the courts of Virudhunagar, Tamil Nadu, India.

14. Amendments

We may amend these Terms at any time. Changes will be posted on our website or communicated via WhatsApp or other channels. Continued use after such notice means you agree to the revised Terms.

15. Termination

  • We may terminate or suspend your access to the Service:
  • If you violate these Terms
  • If required by law
  • In case of technical or security threats
  • Upon termination, your right to use the Service ends immediately.

16. Miscellaneous

  • These Terms are the entire agreement between you and SharaSpot.
  • If any clause is held unenforceable, the remaining parts still apply.
  • Our failure to enforce any part of these Terms does not waive our right to enforce it later.
  • These Terms are governed by the laws of India.
